A POOMES SISTEMAS EMPRESARIAIS S.A., a joint-stock company, registered with the CNPJ/MF under number 17,682,570/0001-01, (“Ploomes”) is the entity that will process your personal data under the terms and conditions set out here. This entity is the owner of the software POOMES CRM SYSTEM (“the Polomes”).
This Privacy Policy aims to clarify how Ploomes collects, uses, and protects your Personal Data. By using our services, you agree to the terms described here.
For the purposes of this Privacy Policy, “Personal Data” refers to any information relating to an identified or identifiable natural person. If you do not agree with this Privacy Policy, do not use our sites, products and services, or any other site or service that links to this Privacy Policy.
This Privacy Policy describes:
- how we treat your personal data, including collection, receipt, use, storage, sharing, and transfer;
- your options and rights related to your Personal Data, such as your rights to access and correct your Personal Data;
Ploomes as a data controller
Ploomes is deeply committed to data protection, for this reason, it has developed this Privacy Policy that applies to the information and data collected by Ploomes when you interact with our sites, products and services, as well as with any other sites or services that have links to this Privacy Policy.
Ploomes as a data operator
When our clients impute and manage Personal Data on Ploomes, Ploomes treats Personal Data as an operator, following the instructions of our clients. Clients, as Data Controllers, are responsible for complying with any regulations or laws that require notification, disclosure, and/or obtaining consent before collecting, processing, or sharing Personal Data.
We update this Privacy Policy from time to time and recommend that you read it periodically at https://www.ploomes.com/legal/privacidade. We will post any changes to the Privacy Policy on our site https://www.ploomes.com/ and, if the changes are substantial, we will send a more prominent notification by e-mail or within the Ploomes system itself. Terms not otherwise defined in this Privacy Policy will have the same meanings as defined in the Terms of Use (https://www.ploomes.com/legal/termos).
1. What information do we collect about you
a. Data that you provide to Ploomes
When you interact with us through our sites or through any sites or services that link to this Privacy Policy or when using Ploomes, we may collect Personal Data and other information from you, as described below.
When you access our sites
We collect your Personal Data when you submit web forms or interact with our sites, sign up for a webinar, subscribe to one of our services, or request customer support. We may ask for your email address, first and last name, job title, and other similar business data. You can also browse our sites without providing any Personal Data.
Information about INBOUND
When you sign up for INBOUND (Courses, Webnars, Trainings, Promotions, Events, etc.) from Ploomes, we collect data such as name, address, telephone number and email address. We use this data to communicate with you and, in some cases, to facilitate your registration. In addition, we may share your registration data with service providers involved in the production to send information about the event and enhance your experience.
Account and user data
We collect Personal Data whenever you create an account on Ploomes, update user information, adjust preferences, or provide data related to the use of the platform.
Payment details
We collect payment and billing information when you sign up to access paid products or services. For example, we may request a billing address or contact for your Ploomes account. If you provide us with payment details, we will only use it as authorized by you under this Privacy Policy.
You can also provide payment details, such as a credit card number or bank account number, when purchasing products or services. We use payment service providers to manage payment processing, which takes place through a secure payment process.
Usage data
We collect usage data when you or the users of your Ploomes account interact with Ploomes. Usage data includes metrics and information about your usage and your interactions with Ploomes, such as which Ploomes features you use the most, when an object (for example, a task) is opened or closed, and how often certain features (such as workflows) are activated in your account.
Móvel
When you access or use Ploomes through the mobile app, we automatically collect data about your device model, version, operating system, and identifier. Our app uses the geolocation functionality of your mobile device, you can activate or deactivate the geolocation permission at any time in your device settings. However, disabling this functionality may limit or prevent the use of certain features of the app
b. Data that we process on behalf of customers when they use Ploomes
Our product allows our customers to create and share marketing, sales, and customer service content. When customers use our product, they may collect Personal Data, such as first and last name, email, address, telephone number, or other data about you. The data that our customers send or collect through the product is owned by the Customer in accordance with our Terms of Use (https://www.ploomes.com/legal/termos).
We don't control the content of our clients' pages or the types of Personal Data they may choose to collect or manage using our product. We store our clients' data on the servers of our service providers, but we treat them as operators, following the instructions of the customers and in accordance with our Terms of Use (https://www.ploomes.com/legal/termos), which prohibit us from using such data, except as required by law and as necessary to provide the service.
Our customers control and are responsible for correcting, deleting, or updating the data they process using our product, and are responsible for complying with any regulations or laws that require the sending of notification, disclosure, and/or obtaining consent before transferring Personal Data to Ploomes for treatment purposes.
Third-party integrations
The Ploomes customer will be able to connect third-party software to their own Ploomes account. It is the responsibility of each customer to review all third-party integrations, especially those integrations that request permissions to access or send data from the Ploomes account.
Any permissions granted by the customer will give these third parties access to their personal data, which may include, without restriction, access to view, store, and modify data in the Ploomes account. We are not responsible for third-party integration practices, so the customer should carefully review the permissions they grant to third-party apps.
We may collect data about what types of integrations each customer uses in their Ploomes account.
Gmail integration
If this integration is activated, Ploomes will be able to send, read, modify, and delete messages. We do not use the data for any type of commercial use or behavioral analysis. The data will be used exclusively for personal use within the software. Ploomes' use and transfer of data received from Google APIs will comply with the Google API Services User Data Policy (https://developers.google.com/terms/api-services-user-data-policy#additional_requirements_for_specific_api_scopes), including limited use requirements.
Chrome extensions
Ploomes for WhatsApp: by installing this extension, you allow Ploomes to identify the number of your WhatsApp contacts to associate them with a Ploomes contact and thus send a conversation to the system through a command. We don't collect data from your conversations without your explicit command.
c. Data we collect from other sources
Ploomes Group
We may receive data about you or other Ploomes account users from other companies in the Ploomes group. The Ploomes group is comprised of the following companies:

Ploomes' partners are individuals and legal entities that assist Ploomes in promoting its brand and increasing its commercialization, with the consequent increase in its customer base.
When partners act to increase the customer base through the referral of a lead, with the sharing of personal data, it is the partner's responsibility to ensure that there is a solid legal basis for data sharing and processing by Ploomes, which in all cases will verify this basis.
We may receive data about you from our partner network through our sales and lead registration process, as we have partners who support our Ploomes marketing process.
We may also collect data about you through our co-marketing partnerships. For example, you can sign up for a webinar or download a white paper published by Ploomes and a Ploomes co-marketing partner.
The Ploomes Group has a strategic partnership with third-party sites for the purpose of promoting the brand. The Ploomes Group's Privacy Policy does not extend to third-party sites and we have no responsibility for the privacy policies of those third parties. We suggest that you check the privacy notices on those sites before sharing information.
Third parties
We may receive your data from service providers, related companies, and our business and solution partners. In this case, it is the responsibility of the provider/partner to ensure that there is a solid legal basis for data sharing and processing by Ploomes, which in all cases will verify this basis.
Personal Data from different sources
We may combine the personal data we collect from you with personal data that we receive from other sources, such as service providers and publicly available sources (such as social media platforms). This data may include postal addresses, job titles, email addresses, telephone numbers, IP addresses, and social media profiles. They help us update and improve our records, identify new customers, create more personalized advertisements, suggest products and services that may interest you, send personalized communications, and promote events. The collection of your Personal Data by these other third parties is governed by the service provider's privacy policy.
Log files
Like most websites and technology services offered over the Internet, we automatically collect and store data about your computer hardware and software when you access our sites, use our products and services, or access other sites or services that link to this Privacy Policy. This data may include: your IP address, browser type, domain names, Internet service provider and the files viewed on our sites (for example, HTML pages, graphics, etc.), the files viewed on our sites or on our client's sites (if these sites are hosted on Ploomes, for example, HTML pages, graphics, etc.), your operating system, access times and referring site addresses.
When you use Ploomes, we collect and store the categories of data listed above in logs in the following instances, subject to customer implementation settings:
• When a Ploomes user logs into their account and accesses tools on the Ploomes Platform;
• When a person accesses a customer's site, if the site is hosted by the Ploomes product; or
• When a person accesses a customer's site, if this site is self-hosted, if the customer uses our plug-ins, and the customer uses Ploomes scripts and content (such as integrated forms).
2. How we use your data
a. To communicate with you about products and services
We use the account data you provide to Ploomes when you subscribe to Ploomes to send you transactional emails or in-app notifications regarding billing, account management, and other administrative issues. We may also send you updates about our Customer Terms of Service or other legal agreements, and we may report security incidents to you via email or in-app notification.
We use your data to provide customer service, for example, to solve technical problems or analyze product flaws or bugs.
If you use the Ploomes mobile apps, we may send push notifications from time to time to keep you informed about events and promotions. If you don't want to receive these communications, turn them off on your device.
b. To enable access to Ploomes and its use as a service
We use your account data to provide products and provide services to you. For example, we use the email address you provide when you subscribe to the product to create your user account, and we use your payment details to process payments for paid use of Ploomes. We may use this data to authenticate your login and provide customer support.
c. To improve and develop our products and services
We collect usage data about how you or your users interact with our products and services. We use this data to develop and improve our products and services. For example, we use usage data to assess product usage trends to help us determine what new features or integrations may be of interest to our users. We use Customer Data in an anonymized form for machine learning purposes that support some features and functionality of the product included in Ploomes.
d. For sending NPS surveys and for new features
If you are registered as a USER on Ploomes, regardless of whether you entered your data yourself or if our client entered your data, we will contact you in the manner and for the purpose provided for in this topic.
We use your data to trigger NPS surveys, seeking to obtain quantitative and qualitative data to assess how satisfied you are with the experience you had (or are having) with Ploomes. We may contact you by phone or email to deepen our understanding of your experience and to improve Ploomes to better serve you.
In addition to NPS, we use your data to send research regarding new features under development or to be developed. The objective is to obtain your feedback on these new features under development or to be developed and thereby improve them to better serve you.
e. To protect Ploomes products and users
We use your account details to investigate and help prevent security incidents. We may also use this data to comply with legal requirements. We use your data to verify user accounts and subscriptions for new products, as well as to detect and prevent product abuse.
We use log files to present general statistics about your use of the sites, including how you use our sites and from which country you are connecting (for analysis, export control and regulatory purposes) and to help improve the browsing experience. Your IP address is also collected and recorded for security and debugging purposes, for example, to track access patterns and investigate security incidents and incidents. For these purposes, we link this automatically collected data to other Personal Data provided by you, such as name, email address, address, and telephone number.
f. To promote and market Ploomes
We use the data you provide to Ploomes to promote and market Ploomes products, services, and other offerings. If you have a call scheduled with a Ploomes representative, we can record and transcribe the call. We'll let you know before the call that it will be recorded, and you'll have the option to choose not to have the call recorded.
We receive data from service providers and other sources, such as business information service providers and publicly available sources. We may receive and use data from these service providers and other sources along with other data that we collect through other means described in this Privacy Policy in order to provide you with updates and an improved Ploomes, such as personalized communications, event promotion, and adaptation of websites or products to improve the user experience.
g. To allow for check-ins at specific locations.
This functionality is essential for the delivery of certain services and guarantees the accuracy of the information related to your location at the time of use. We use your location only to authenticate check-ins at authorized locations and for operational purposes related to the contracted service.
h. Other purposes if we obtain your consent
We share your data with third parties when you authorize us to do so.
i. Legal basis for processing Personal Data (only for visitors from the EEA and the United Kingdom)
If you are a visitor to a site and are located in the European Economic Area (“EEA”) or the United Kingdom, Ploomes is responsible for your Personal Data. To contact Ploomes' Data Protection Officer, please send an email to dpo@ploomes.com.br.
Our legal basis for collecting and using the Personal Data described above will depend on the Personal Data in question and the specific context in which we collected it. However, we normally collect your Personal Data only when we have your consent or when the processing of that data is in accordance with our legitimate interests without prejudice to your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect your Personal Data.
If we ask you for Personal Data to comply with a legal requirement or to fulfill contractual obligations entered into with you, we will make this clear at the relevant time and will inform you whether the provision of your Personal Data is mandatory or not (as well as the possible consequences if you do not provide them). Likewise, if we collect and use your Personal Data based on our legitimate interests (or the interests of a third party), we will make it clear to you at the relevant time what those legitimate interests are.
3. How we share the data we collect
a. Service providers
We hire service providers to support our sites, products, and services. For example, we use service providers for data hosting, application development, and marketing. We may need to share your data with them so that they can provide you with information about products or services. Examples may include removing repeated data from prospect lists, performing statistical or data analysis about your use of Ploomes or interactions on our sites, providing marketing assistance, processing credit card payments, supplementing the information you provide to us to provide better service, developing and improving products and services, and providing support or customer service. These service providers are prohibited from using your Personal Data, except for these purposes, and they are required to preserve the confidentiality of your information. In all cases where we share your information in this way, we explicitly require the service provider to recognize and comply with our data protection and privacy standards and policies.
b. Partners
We may share data with Ploomes partners to contact you based on your express consent to this sharing. Under no circumstances will these partners use your Personal Data for purposes other than those for which it was disclosed and will be required to preserve the confidentiality of your information.
c. Companies in the Ploomes Group
We may share data with the other companies in the Ploomes group, already mentioned above, so that they can contact you to verify that you are interested in the solutions and tools they have.
d. Corporate Events
If we (or our assets) are acquired by another company, whether through a merger, acquisition, bankruptcy, or otherwise, that company will receive all the data collected by Ploomes about the sites and Ploomes. In that case, you will be notified via email and/or a prominent notice on our website about any change in company ownership, use of your Personal Data, and choices you may have regarding your Personal Data.
e. Public forums
Our sites may offer message boards, blogs, and community forums for public access. Keep in mind that if you directly disclose any data through our message boards, blogs, or public forums (including profile information associated with the account you use to post the information), that data can be read, collected, and used by any member of the public who accesses those sites. Your posts and certain profile information may remain even after you close your account. We recommend that you consider the susceptibility of any information that you may disclose in this way. If you request, we will correct or delete any information you have posted on the sites.
f. Disclosure obligation
We reserve the right to use or disclose your Personal Data if this is required by law or if we reasonably believe that the use or disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a law, court order, or legal process.
4. How we store and protect your data
a. Data storage and security
We use various security technologies and procedures to help protect your Personal Data against unauthorized access, use, or disclosure. We protect the Personal Data that you provide on computer servers in a controlled, secure environment, and protected against unauthorized access, use, or disclosure. All Personal Data is protected by physical, technical, and organizational measures.
b. Retention of Personal Data
The period for which we retain data that we collect about you depends on the type of data and how we collect and store it. After a reasonable period of time, we will delete or anonymize your data or, if this is not possible, we will securely store it and isolate it so that it is not used until deletion is possible.
We retain Personal Data that you provide to us when we have an ongoing legitimate business need to do so (for example, as necessary to comply with our legal obligations, resolve disputes, and enforce our contracts).
When we do not have an ongoing legitimate business need to process your Personal Data, we will delete or anonymize your data or, if this is not possible, we will securely store your Personal Data and isolate it so that it is not treated until deletion is possible. We will delete this data at an earlier date if you so request.
If you have chosen to receive marketing communications from us, we will retain data about your marketing preferences for a reasonable period starting from the last date you expressed interest in our content, products, or services, such as the last time you opened an email sent by us or stopped using your Ploomes account. We retain information derived from cookies and other tracking technologies for a reasonable period from the date that such information was created.

6. How to access and control your Personal Data
a. Review, correct, and remove your Personal Data
You have the following data protection rights:
• You can request access, correction, updating, or deletion of your Personal Data.
• You can object to our processing of your Personal Data, ask us to restrict the processing of your Personal Data, or request the portability of your Personal Data.
• If we have collected and processed your Personal Data on the sole legal basis of your consent, you can revoke your consent whenever you want. The withdrawal of your consent will not affect the lawfulness of any treatment we conducted before the cancellation nor will it affect the processing of your Personal Data conducted in accordance with lawful processing regardless of your consent. It should be noted that, if there is another legal basis for the treatment, the revocation of consent will not imply the interruption of the treatment.

We will comply with your request to change, correct, or delete your data within a reasonable time and will notify you of the action we take.
If you are a customer, prospect, or interact with one of the Ploomes clients that uses Ploomes and you want to access, correct, change, or delete your data controlled by that customer, please contact the customer with whom you interact directly. Ploomes acts as an operator for our customers and will cooperate with them to fulfill these requests when appropriate.
b. Anti-spam
Ploomes will not send unsolicited commercial emails and every email you send will include an “opt out” mechanism and other mandatory information.
c. To unsubscribe from our communications
You can unsubscribe from our marketing communications by clicking on the “unsubscribe” link located at the bottom of our emails.

8. Other important privacy information
a. We never sell Personal Data
We will never sell your Personal Data to third parties.
b. Children's data
The sites, products, and services are not intended or directed at children under 16, and we do not knowingly or intentionally collect Personal Data about children under 16. If you suspect that we have collected Personal Data about a child under 16, please contact us here so that we can delete it.
